Requirements for a Guarantor
Individual or Company Acting as Guarantor (Real Estate as Collateral)
When a lease agreement uses a guarantor with real estate as collateral, the investigation includes both the guarantor and the property offered as security.
Property documentation (required in both cases)
· Property deed registered with the Public Property Registry, free of liens, or deed of mortgage cancellation.
· Current property tax bill (Predial) of the property offered as collateral.
· Proof of address of the property used as collateral.
The property must be free of liens, have a reasonable value in proportion to the rent, and be located in a jurisdiction where legal enforcement is viable. This is verified during the investigation process.
If the Guarantor is an Individual
· Valid official identification. If foreign, copy of immigration document.
· Current proof of address.
· Tax Status Certificate (Constancia de Situación Fiscal).
· Marriage certificate. If married under community property regime, the spouse must also sign the lease agreement.
If widowed, a copy of the will or probate ruling is required.
· Legal policy application form.
· Updated Tax Status Certificate.
If the Guarantor is a Company (Legal Entity)
· Company Articles of Incorporation.
· Power of attorney of the legal representative.
· Official identification of the legal representative. If foreign, copy of immigration document.
· Proof of company address.
· Tax Status Certificate.
· Legal policy application form.
Note: The legal policy includes verification of the Certificate of No Liens on the property, or it may be provided by the guarantor with a maximum validity of one month.
